GNC Privacy Notice

1. Scope and Overview
This Privacy Notice describes what information GNC Holdings, LLC and its subsidiaries (“GNC,” “we,” “us,” or “our”) collect from and about you, how we use and disclose that information, and how you can manage your information and privacy choices.
This Privacy Notice applies where it is posted and to information collected through websites we own or operate (“GNC Websites”), apps published by GNC (“GNC Apps”), email newsletters, other interactive features and communications provided by GNC, GNC stores, call centers, events, promotions, and the GNC Loyalty Program. Collectively, these are referred to as the “GNC Outlets.”
This Privacy Notice does not apply to independently operated GNC franchisees. GNC franchisees may operate their own stores, websites, services, and data practices, and may partner with third parties who treat information differently or use other tracking technologies. If you have questions about a franchisee’s privacy practices, contact that franchisee directly.

We may update this Privacy Notice from time to time. Updates will be reflected on this page, and the “Last Updated” date will identify the date of the most recent update.
2. Information We Collect
We collect information from and about you when you interact with GNC, including when you visit or use GNC Outlets, make a purchase, create an account, join or use the GNC Loyalty Program, participate in a promotion or survey, contact customer service, visit a store, engage with us on social media, or otherwise interact with our products or services.

Sensitive Personal Information
Depending on how you interact with us, some information may be considered sensitive personal information under applicable law. This may include account login credentials, payment-card information, precise geolocation where enabled, demographic information that is legally protected, and information that may reveal or be used to infer health or wellness interests. We use sensitive personal information only as reasonably necessary to provide requested products or services, process transactions, maintain account security, prevent fraud, comply with legal obligations, or for other purposes permitted by applicable law.
Children’s Information
GNC Websites, GNC Apps, and interactive features are not intended for children under 13. We do not knowingly collect personal information from anyone under 13. If you are under 13, please do not send us personal information.
Social Media, Promotions, Referrals, and Other Sources
If you interact with GNC through social media, participate in surveys, sweepstakes, promotions, contests, or referral programs, or use a social media login, we may collect identifiers and contact information, such as your name, email address, username, social media handle, mailing address, or phone number; information you submit in connection with the applicable feature, such as survey responses, promotion entries, preferences, reviews, feedback, photos, comments, or other content; and information needed to verify eligibility, administer the program, communicate with you, and fulfill prizes or rewards. If a third party sponsors or operates a promotion, referral program, or social media platform, its privacy practices may also apply.
We may also receive information from service providers, advertising and analytics partners, fraud-prevention providers, data providers, affiliates, or other sources where permitted by law.
3. How We Use Information
We use personal information for business and commercial purposes, including the purposes described below.

Targeted Advertising, Sale, and Sharing
Some privacy laws define “sale,” “sharing,” and “targeted advertising” broadly. Depending on the law, our use of advertising, analytics, measurement, personalization, retargeting, or similar technologies may be considered a sale or sharing of personal information or processing for targeted advertising, even though we do not sell personal information for money. You may opt out of these activities through the “Cookie Preferences” link of the cookie banner, cookie preference center at the bottom of our webpage, or other methods described in this Privacy Notice.
Combining Information
We may combine information collected through different GNC Outlets, stores, websites, apps, services, loyalty programs, or other interactions into a single customer record or analysis, where permitted by law. We may also combine information we collect with information received from service providers, affiliates, or other sources to update records, personalize experiences, improve products and services, prevent fraud, and support business operations.
4. How We Disclose Information
We may disclose personal information to the following categories of recipients, depending on the context and applicable law:
- Service providers, contractors, processors, and vendors that support our operations, including payment processing, order fulfillment, delivery, customer service, IT, hosting, security, analytics, fraud prevention, marketing support, and similar services.
- Advertising, analytics, measurement, personalization, and marketing partners, where permitted by law and subject to applicable privacy choices.
- Affiliates and entities within the GNC corporate family, where permitted by law.
- GNC franchisees where necessary to provide requested services, administer loyalty benefits, or support operations, subject to applicable legal and contractual controls.

- Persons or entities involved in security, fraud prevention, debt collection, emergency situations, or protection of rights, property, safety, or legal interests.
- Parties to a potential or completed merger, acquisition, financing, restructuring, bankruptcy, sale of assets, or similar business transaction.
- Other parties with your consent or as otherwise permitted by law.
Loyalty Program and Financial Incentives
GNC may offer financial incentives, such as discounts, coupons, special offers, rewards points, or loyalty benefits. Participation is optional, and additional program terms may apply. The value of any financial incentive is reasonably related to the value of the information provided or collected in connection with the program, including expenses associated with collecting information, providing the incentive, generating revenue through the program, and improving products and services based on program information.
If personal information necessary to administer a loyalty account is deleted, GNC may be unable to continue providing loyalty benefits associated with that account.
5. Your Privacy Rights and Choices
Depending on where you live, you may have rights regarding your personal information. These rights may include the rights to know/access, obtain a copy, delete, correct, opt out of sale, sharing or targeted advertising, limit certain uses of sensitive personal information, withdraw consent, appeal a denied request, and not be discriminated against for exercising privacy rights.
How to Exercise Your Rights
To submit a privacy request, visit https://privacy.gnc.com/consumer/index. You may also contact Customer Service at customer-service@gnc-hq.com, by phone at 1-877-GNC-4700, or by mail at GNC Customer Service, 75 Hopper Place, Suite 501, Pittsburgh, PA 15222.
Identity Verification and Authorized Agents
We may need to verify your identity before processing certain requests. Verification may require contact information or other identifiers based on your relationship with us. You may designate an authorized agent to submit requests on your behalf where permitted by law. We may require proof of authorization and may ask you to verify your identity directly with us.
Opt-Out of Sale, Sharing, and Targeted Advertising
You may opt out of sale, sharing, or targeted advertising through the “Cookie Preferences” link, our privacy request portal, cookie preference center, or other methods we make available. We do not sell personal information for money; however, some disclosures to advertising, analytics, measurement, or marketing partners may be considered a sale, sharing, or targeted advertising under applicable privacy laws.
Global Privacy Control and Opt-Out Preference Signals
Some browsers and browser extensions support Global Privacy Control (“GPC”) or other opt-out preference signals. Where required by applicable law, we recognize and process GPC signals as a request to opt out of the sale or sharing of personal information and targeted advertising for the browser or device from which the signal is transmitted. You may still need to use our “Cookie Preferences” link or privacy request portal to apply choices more broadly.
Appeals
If we deny a privacy request and applicable law gives you appeal rights, you may appeal by using the contact methods listed above. We will respond within the timeframe required by applicable law and provide information required by law.
California Shine the Light
California residents may request information regarding disclosure of personal information to third parties for their direct marketing purposes under California Civil Code Section 1798.83. To make such a request, email customer-service@gnc-hq.com.
6. Protection and Retention of Information
Security
We maintain administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Passwords
Online account access is protected by a password you select. We recommend that you keep your password confidential. GNC will not ask for your password in an unsolicited communication.
Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Notice, including to provide products and services, administer accounts and loyalty benefits, process transactions and returns, comply with legal and regulatory obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, and support legitimate business needs. Retention periods vary based on the category of information, context of collection, legal requirements, contractual obligations, and operational needs.

We and our service providers, advertising partners, analytics providers, and other third parties may use cookies, pixels, tags, web beacons, SDKs, scripts, and similar technologies to operate GNC Websites and GNC Apps, remember preferences, understand how digital services are used, personalize content, measure advertising effectiveness, and deliver or support advertising.
These technologies may collect or receive information such as IP address, device identifiers, browser type, pages viewed, products or categories viewed, session information, interactions with GNC Websites or GNC Apps, and referring URLs. Some technologies are necessary for basic website functionality, security, checkout, account access, shopping cart functionality, fraud prevention, and saving privacy preferences. Flashtalking and Google Services
GNC may use Flashtalking or similar platforms for ad creation, delivery, device recognition, campaign attribution, and advertising campaign analysis. GNC may also use Google services, including analytics, tag management, advertising, conversion measurement, or app-related services. These services may collect or receive device, internet, network activity, usage, advertising, or attribution information as described in this Privacy Notice.
8. Consumer Health Data Notice
This Consumer Health Data Notice supplements the Privacy Notice and applies only to personal information that may be considered “consumer health data” under applicable consumer health data laws, including the Washington My Health My Data Act and Nevada consumer health data law, as applicable.

Because GNC offers health, wellness, nutrition, supplement, and related products and services, information about your browsing activity, purchases, searches, product/category views, loyalty activity, preferences, or interactions with GNC may reveal or be used to infer health, wellness, fitness, nutrition, or similar interests. Depending on applicable law and context, this information may be considered consumer health data.

9. International and Partner-Operated Websites
GNC’s U.S. websites, apps, products, and services are intended for users in the United States. GNC products may also be distributed or sold in other countries through independently operated distributors, franchisees, licensees, or other business partners. Those partners may operate their own websites, stores, services, loyalty programs, marketing programs, cookies, tracking technologies, and privacy practices. This Privacy Notice does not apply to websites, services, or data practices operated independently by those partners.
